These terms govern the use of the Fyzivo app (the “app”). The app is operated by Jan Herrmann, a sole trader registered in the Czech Trade Register, ID No. 07279469, registered office Na Malé Straně 134/29, 747 17 Darkovice, Czech Republic (“we”), e-mail kineoflow@gmail.com. By using the app you agree to these terms. If you do not agree with them, please do not use the app.
What the app offers
The app offers instructional exercise videos in the field of physiotherapy and fitness, prepared by a physiotherapist, and lets you track your own progress (favourite and completed exercises, statistics). The app is free. You can use it without an account as a guest; with an account your progress is stored permanently and you can sign in on another device too.
Health notice
- The app is not a medical device and does not replace examination or treatment by a doctor or physiotherapist. It does not diagnose, treat, cure or prevent any disease.
- The exercises are general; they are not designed for your specific health condition.
- Consult a doctor or physiotherapist before you start exercising, especially if you have health problems or pain, have had an injury or surgery, or are pregnant.
- Follow the instructions in the video and only exercise within a range that does not cause you pain. If you feel pain, dizziness, shortness of breath or any other discomfort, stop immediately and seek professional help; in an emergency call 112.
Liability
We keep developing the app and do not guarantee that it will always be available without interruption or errors. We are not liable for harm caused by your not following the instructions in the videos or the health notice above. This does not affect your statutory rights as a consumer or our liability to the extent that it cannot be excluded or limited by law, in particular for harm to health and for harm caused intentionally or by gross negligence.
User account
You can create an account for free with your e-mail and a password. Provide accurate details and keep your sign-in details safe from misuse. You can delete your account at any time in the app (Profile → Delete Account) or as described on the account deletion page.
Paid features
If the app offers paid features in the future, you will see their price and terms in the app before you buy. Payments, subscription renewals and refunds are handled by the Apple App Store or Google Play under their terms.
Intellectual property
The videos, texts, graphics and other content of the app are protected by copyright and belong to us or our licensors. You may use them only for your own purposes within the app; you may not copy, distribute or otherwise publish them without our consent.

Acceptable use
You must not misuse the app, disrupt its operation, attempt unauthorised access, or use it for unlawful purposes.
Termination
You can delete your account at any time. If you seriously or repeatedly breach these terms, we may restrict your access or close your account. Should we ever discontinue the app, we will let you know well in advance.
Changes to these terms
We may change these terms, for example because of new features or changes in the law. We will inform you of material changes in advance by e-mail or in the app; if you do not agree with a change, you can delete your account. The current version is always available on this page with the date of the last update.
Governing law and disputes
These terms are governed by Czech law. If you are a consumer living in another country, this does not deprive you of the protection given to you by the mandatory provisions of the law of your country of residence. Consumer disputes can also be resolved out of court; the competent body is the Czech Trade Inspection Authority (adr.coi.cz).
